Rule 83
Family Pension and Gratuity
(1) If a military person dies while in service or within seven years of receiving pension, his family shall receive gratuity or pension as prescribed in rule 79 or 80. But in case of pension, such pension will not be received for more than seven years. The family of a soldier who died before seven years of receiving pension will not receive pension after seven years.
(2) Notwithstanding anything written in sub-rule (1), if the person receiving pension is a minor, he shall receive such pension until he reaches the age of eighteen years.
(3) If the widowed spouse or widowed wife of a military person leaves the service or dies within seven years of starting to receive pension, the family pension shall be received as per sub-rule (1) from the date of payment of the pension period and if such pension is not received, or his spouse or If the wife dies after seven years have passed since she started receiving the pension, she will get half of the pension from the date of her death.
(4) If a military person dies before receiving any amount due under this regulation, the person who is determined to receive his pension or gratuity from among the members of his family will be entitled to receive that amount.
(5) When giving pension or gratuity, if the deceased military person has wished for someone, and if the person is unable to receive it for some reason or if no one has wished, then the amount will be given to a person from among the members of his family whom the Government of Nepal deems appropriate.
(6) If a military person dies while performing his duty, regardless of how many years his service period has reached, the closest person to the family of the deceased military person shall be given half of the salary earned by such military person as a family pension and also a family gratuity as follows:-
(a) In case of death before completing the service period of ten years, an amount equal to six months' salary received by him,
(b) Death after completion of ten years to twenty years of serviceAn amount equal to the salary of nine months that he had received,
(c) If he dies after completing any service period of more than twenty years, an amount equal to one year's salary earned by him.
(7) If a military person dies due to a sudden accident during military action or military deployment, or dies without recovery immediately, such a military person will be posthumously promoted to a higher position and the full salary according to that position will be given to his family for a maximum period of seven years, not exceeding the retirement age of such a military person. After the period of receiving full pay has passed, the family of the deceased soldier will receive pension according to the service period of the deceased soldier: if it is less than the period of receiving pension, the same as the period of receiving pension and if it is more than the period of receiving pension.
(8) According to sub-rules (6) and (7), the gratuity and family pension of the deceased military person shall be received for life in the case of the spouse, father, mother, and in the case of a son or daughter, they shall receive the gratuity and family pension until the date of completion of the age of twenty-one years or entry into government service, whichever is earlier.
(9) When the salary of a serving soldier is increased, two-thirds of the increase in the initial salary will be added to the family pension received by the person receiving family pension according to this rule.
(10) If the widowed husband or widowed wife of a soldier who is receiving pension according to this regulation remarries, he will not receive pension.
(11) According to sub-rule (7), if the husband or wife of a soldier dies while receiving family pension, the family pension received by him, if he has a son or daughter, all the children will be divided equally until they reach the age of twenty-one years. It will be added.
(12) Regardless of what is written in sub-rule 10), if the widower or widower of a military person who is receiving pension remarries, the minor children of such military person shall receive such pension payment as prescribed until they reach adulthood.will take
(13) Prior to the implementation of this rule, according to sub-rule 7), the family of the military person shall provide the facilities as mentioned in this rule so that the retired pension is not reduced.
(14) Notwithstanding anything written elsewhere in this rule, a person who has acquired the citizenship of another country or obtained a permanent residence permit in another country shall not receive the family allowance and gratuity as per this rule.
